Heard learned counsel for respective parties. 2.

By way of present petition, the petitioner assails the order dated 28.02.2023 passed by respondent no.3/the Additional Commissioner, Aurangabad in Case No.63 of 2021, against which, the petitioner is having an alternate remedy of filing second revision before the State Government.

In view of the same, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file second revision before the State Government.

In view thereof, the petition is disposed of with liberty to the petitioner to file second revision before the State Government within a period of eight weeks from today.

The time spent while prosecuting the present petition shall be taken into consideration by the State Government while considering the application for condonation of delay. 6.
