Learned counsel for the petitioner places on record the original communication from the petitioner stating that the matter has been settled and the petitioner desires to withdraw this petition. Copy of the no dues certificate is also annexed.

The above referred documents are taken on record and collectively marked as Exhibit "X" for identification. The learned counsel for the Bank confirms that the matter is settled with the petitioner. He further submits that the amount deposited in this Court be returned to the petitioner, provided some donation is made for the treatment of poor patients. This petition is, therefore, disposed off in view of the document Exhibit "X". On the request of the petitioner, he is permitted to withdraw an amount of Rs. 22,500/- under identification of the learned Advocate. The remainder amount of Rs.2,500/- with accrued interest, if any, shall be transferred by the Nazir Section to the Government Medical College and Hospital, Aurangabad, through Medical Officer, High Court Dispensary, Aurangabad, either in cash or by Demand Draft (Demand Draft be drawn in the name of "Dean, Government Medical College and Hospital Dengi Samiti, Aurangabad"), within four weeks from today.
