We have heard Mr. Kulkarni, learned counsel for the petitioner.

Mr. Hon, learned counsel for respondentMunicipal Counsel submits that at present other development activities are taking place and respondent cannot acquire the land by private negotiation, though resolution was passed earlier. 3.

In view of that, the petitioner would have remedy under Section 127 of Maharashtra Regional and Town Planning Act, 1966. The petitioner may avail the said remedy or such other remedy as is permissible under Act.

Writ Petition is disposed of. No costs.
