We have heard Mr. Thombre, learned counsel for the petitioner. Learned counsel submits that only because the departmental enquiry is pending against the petitioner, the petitioner is not allowed to participate in the admission process for PG Course. According to learned counsel, there is no impediment to allow the petitioner to take part in the selection process even if departmental enquiry is pending. Department enquiry is based on erroneous ground.

Learned AGP submits that in view of Government Resolution dated 3rd May, 2011, the petitioner is not entitled to be considered for admission to the PG course as in service candidates. 3.
This Court vide judgment and order in Writ Petition No. 4326 of 2013 has already held that, in view of clause 1.5 of Government Resolution dated 03.05.2011 person against whom departmental enquiry is pending is not eligible for admission to P. G. course. 4.
In the light of above and in view of the judgment delivered by this Court in Writ Petition No. 4326 of 2013, grievance of the petitioner cannot be considered. Writ petition, as such, stands dismissed. No costs. (V. K. JADHAV, J.) ( S. V. GANGAPURWALA, J. ) JPC 1/1
