In similar set of circumstances, in Writ Petition No.8836/2021, we had cast the responsibility on the District Collector to initiate action against the errant officer for having not implemented the order dated 01.03.2021, for almost 14 months. In the present case, the Petitioner's grievance is voiced before the Divisional Commissioner, Ch. Sambhajinagar concerning a service road to be created parallel to the National Highway and the presence an of encroached tin structure which has become an impediment for laying of the service road. The Deputy Commissioner, Municipal Administration from the office of the Divisional Commissioner, Ch. Sambhajinagar has already directed the Chief Officer, Ambad Municipal Council, Dist. Jalna to initiate appropriate

( 2 ) 914 wp 5761.24 steps to ensure that such encroachments are removed by following the due procedure laid down in law.

In view of the above, this Writ Petition is disposed off with a direction to the Divisional Commissioner, Ch. Sambhajinagar to inform the Chief Officer, Municipal Council, Ambad to initiate appropriate steps by following the due procedure laid down in law for ensuring that the work to be carried out under the "Vaishishtyapurna Nidhi Yojna" under which work orders have already been issued, is taken to fruition, expeditiously.
