DATED : 18 th June, 2015 PER COURT :- 1] These two applications can be disposed of by common order since those arise out of Crime No. 73 of 2015, registered at Jamner police station, District Jalgaon, for the offences punishable under Sections 170 of the Indian Penal Code and under Sections 3, 4/25 of the Arms Act. 2] Heard respective counsel for the applicants in the respective application and Smt. Pratibha Bharad, learned Additional Public Prosecutor for the respondent/State. 3] From the reply filed on behalf of the investigating officer, from Jaffrey Francis Crasto one Samsung Galaxy Note-2 Mobile and cash of Rs.4,690/- are recovered and from Gerard Peter Rebello one Nikon Camera and cash of Rs.2,520/- are recovered; and from Christopher Thomas Viegas one rifle is recovered.
4] Principally, the applicants are charged for the offence punishable under Section 170 of the Indian Penal Code, since according to the allegations made in the first information report, the car in which these persons were travelling was intercepted and same was found to have sticker of Maharashtra Government.
5] It is reported and which is corroborated by the learned Additional Public Prosecutor that the present applicants are languishing in jail since 2.5.2015. Learned Additional Public Prosecutor, upon instructions, made a statement that entire investigation is over and charge sheet is likely to be filed on 25.6.2015. In that view of the matter, the applicants can be released on bail on certain conditions.
O R D E R
(i) Criminal Application No. 2749 of 2015 is allowed.
(ii) Applicants-Jeffrey Francis Crasto and applicant-Gerard Peter Rebello be released on bail, in connection with Crime No. 73 of 2015, registered at Jamner police station, District Jalgaon, for the offences punishable under Sections 170 of the Indian Penal Code and under Sections 3, 4/25 of the Arms Act, on they each executing P.R. bond of Rs.50,000/- with one solvent surety in the like amount by each of them. (iii) Bail before the trial court.
(iv) The applicants-Jeffrey and Gerard shall attend Jamner police station once in a week, preferably on Sunday between 3.00 p.m. to 5.00 p.m. till the charge is framed.
(v) Criminal Application No. 2820 of 2015 is allowed.
(vi) Applicants-Christopher Thomas Viegas be released on bail, in connection with Crime No. 73 of 2015, registered at Jamner police station, District Jalgaon, for the offences punishable under Sections 170 of the Indian Penal Code and under Sections 3, 4/25 of the Arms Act, on he executing P.R.bond of Rs.50,000/- with one solvent surety in the like amount.
(vii) Bail before the trial court.
(viii) The applicant-Christopher shall attend Jamner police station once in a week, preferably on Sunday between 3.00 p.m. to 5.00 p.m. till the charge is framed.
(x) Applications are disposed of.
