Heard learned counsel for the applicant.

Considering the fact that the respondent has denied his signature over the cheque but has been proved and finding that there is an arguable case regarding the rebuttal of presumption that has arisen due to disputed signature over the cheque, leave to file appeal is hereby granted. The application is accordingly allowed.

The office to register the appeal as per due procedure of law. Upon registration of the appeal, it stands admitted. Action under section 390 of the Code of Criminal Procedure to follow.

The learned Judicial Magistrate First Class, Latur to release the respondent on bail for remaining present in this court in the appeal proceedings, on his executing P.R. bond in the sum of Rs. 20,000/- (rupees twenty thousand) and also upon furnishing surety in the like amount.

Hamdast of this order is allowed for placing the same before the learned Judicial Magistrate First Class, Latur.
