PER COURT:- 1.

The learned advocate for the petitioner submits on specific instructions that the petitioner is canvassing only prayer clause (C) which reads as under :- "(C) By issuing writ of mandamus or any other appropriate writ or directions, the Respondent Nos. 1 to 3, may kindly be directed to start the election process for holding elections of APMC, Dharur to constitute a democratically elected Managing Committee within a period of three months."

The learned advocate representing the added respondent No. 4 states in paragraph No. 4 of the affidavit in reply that the elections to

2 7-wp 6571-2022.odt 34 Primary Agricultural Credit Co-operative Societies are being conducted. Thirteen Directors on the market committee have been elected from such societies. Twenty eight out of such 34 societies are eligible to hold elections as on 31.03.2022. Twenty societies have already undergone such elections. Election in seven societies is in progress and voters list in one society is yet to be published. Thus, elections would be concluded by 31.08.2022.

It is further stated in paragraph No. 5 of the affidavit in reply that, pursuant to the above, the elections to the APMC would be concluded as per the provisions of the Maharashtra Agricultural Produce Marketing (Development and Regulation) Act, 1963 read with Election to committee Rules, 2017, in a period of four (04) months, if there is no legal impediment.

The learned advocate for the petitioner submits on instructions that the petitioner is satisfied.

In view of the statements made in paragraph Nos. 4 and 5 of the affidavit in reply dated 11.07.2022 filed on behalf of respondent No. 4, this petition is disposed off.
