The applicant's tractor - trolley bearing No. MH-19-BG-8027 was found on the bank of river, where sand was excavated without permit. The applicant had applied and sought return of the trolley by making an application under section 457 of the Cr.P.C. Prima facie, it establishes complicity of the applicant in the crime. Besides, there are two criminal antecedents against the applicant. In the circumstances, custodial interrogation of the applicant cannot be denied to the State. 02.
