DATED : 15 th June, 2015 PER COURT :- 1] This is an application for regular bail since the applicant is arrested in connection with Crime No. 98 of 2015, registered at Sangamner City police station, District Ahmednagar, for the offences punishable under Sections 307, 326, 323, 341, r/w 34 of the Indian Penal Code. For the same incident, another first information report is filed by Namdeo, the brother of present applicant, however, belatedly on 10.5.2015. From the first information report, it appears that the present applicant and another accused Arun, whose identity is disclosed subsequently as Namdeo Gunjal has smashed the present applicant on the tar road due to which he has suffered serious injuries.

2] I have heard Shri A.N.Nagargoje, learned counsel for the applicant and Shri U.S.Mote, learned Additional Public Prosecutor for the respondent/State.

3] The investigation papers which are handed over to the court for perusal by the learned Additional Public Prosecutor shows that investigation is almost over and the formality of filing of charge sheet is only remained. The applicant is

crap2777.15 arrested on 11.5.2015. The injured is already discharged from the hospital. Therefore, the offence is not converted into more graver one. The applicant, therefore, can be released on bail on certain stringent conditions. That leads me to pass following order.

O R D E R

(i) Criminal Application is allowed.

(ii) Applicant-Shantaram Baban Gunjal be released on bail, in connection with Crime No. 98 of 2015, registered at Sangamner City police station, District Ahmednagar, for the offences punishable under Sections 307, 326, 323, 341, r/w 34 of the Indian Penal Code, on he executing P.R.bond of Rs.25,000/- with two solvent sureties in the like amount.

(iii) Bail before the trial court.

(iv) The applicant shall attend police station Sangamner City, District Ahmednagar twice in a week preferably on every Sunday between 3.00 p.m. to 5.00 p.m. till the charge is framed. (v) The application is disposed of.
