Mr. Shinde, learned Counsel for the petitioner submits that the petitioner is working in the school at Gangapur since two years. The minor daughter of the petitioner namely Afifa, aged 2 years, has intermittent attacks of epilepsy and they are staying at Aurangabad. The petitioner has given representations to give her posting within the radius of 20 to 25 kms from Aurangabad city in any other Urdu Medium School. That representations are not considered.

Mr. Ghute, learned Counsel, on instructions submits that the representations would be considered by the Authority considering the vacancies available.

Considering the facts and circumstances of the present case, respondent No.3 shall consider the application filed by the petitioner for transfer within the radius of 20 to 25 kms of Aurangabad sympathetically, in case the vacancy is available within the radius of 20 to 25 kms of Aurangabad city. The application shall be considered expeditiously, preferably within two weeks. 4.

Writ Petition is disposed of. No costs.
