In compliance with the order dated 08th September, 2025, learned A.P.P. submitted that she has received communication from the concerned PSI, Nardana Police Station, and he informed that the appellant's death is not registered anywhere; however, he has obtained the death certificate from the concerned hospital and annexed the certificate along with his report. She has tendered the said death certificate along with pursis across the bar. The same is taken on record and marked 'X' for identification purposes. 2.
I have perused the said report and death certificate. It appears that the said certificate was issued after conducting the postmortem report of the appellant, Suresh, wherein the cause of death is mentioned as "Purulent peritonitis". Thus, it is evident that appellant Suresh died on 04th February, 2013. In view of this, the criminal appeal is abated against him and disposed of. ( ABHAY J. MANTRI, J. ) SSD 1 / 1
