Heard the learned counsel for the applicant and the learned APP for the State.

It is an unfortunate that the applicant is behind the bar for 50 days for the offences punishable under Sections 353 and 332 of the IPC. The FIR reveals that the applicant / accused has barely pulled the complainant and slapped him on his chick and ear. Bare reading of the FIR reveals that nothing was to be recovered and discovered from the applicant.

3. Learned APP opposed the application contending that there are eye witnesses and offence is serious. It has been alleged against the applicant that he is habitual offender and

some crimes are registered against him. The nature of the offence is to be considered.

Having regard to the facts discussed above, this Court is of the view that there is no propriety in keeping the applicant behind bars. The application deserves to be allowed. Hence, the following order :

O R D E R

(A) The application is allowed.

(B) The applicant Rana Mahendra Bansode be released on bail on furnishing P.B. and S.B. of Rs.15,000/- (Rupees Fifteen Thousand only) with one solvent surety of the like amount in Crime No.104 of 2022, registered by Police Station Osmanabad City, District Osmanabad, for the offences punishable under Sections 353, 332, 504 of the IPC, on the following conditions :

(i) He shall not involve in similar offence.

(ii) He shall attend the Police Station as and when called by the Investigating Officer.

(iii) He shall attend the case after charge sheet is filed on each effective date of hearing.

(iv) He shall not tamper with the prosecution witnesses.

(iii) Humdast allowed.
