Heard the learned AGP and the learned Advocate for the respondent who appears suo-moto.

At the outset, it is necessary to note that learned AGP fairly concedes that the petition was filed when law was still to be cystilized by the Supreme Court.

3. It is a matter of grant of increment earned in the last year of the superannuation. In the matter of the Director of (Admn. and HR) Kptcl Vs C. P. Mundinamani reported in 2023 LiveLaw (SC) 296, the issue has been finally concluded by the Supreme Court.

The order of the Tribunal being in tune with the observations and the conclusions of the Supreme Court, there is no merit in the petition. Hence, the petition is dismissed.
