The petitioner is objecting to certain conditions incorporated in the tender notice.

After hearing the matter for quite some time, the department i.e. Executive Engineer, Public Works Division, Nanded, has communicated decision of the department to recall the tender process and issue fresh tender notice with suitable modifications relating to qualification criteria. The communication dated 20.07.2015, issued by the Executive Engineer, Public Works Division, Nanded, is taken on record and marked "X" for identification.

Since the tender process itself is being withdrawn, nothing survives for consideration in the writ petition. Learned Counsel for the petitioner makes a request that the petitioner shall

{2} wp564915.odt be permitted to undertake the work of maintenance of the Rest House during intervening period. It would be for concerned authorities to determine as to what arrangement shall be made during intervening period and we do not propose to issue directions in that regard.

In view of above, writ petition stands disposed of with liberty to the petitioner to avail of the remedies available in law as and when occasion arises.
