ORDER :

We have heard learned counsel for the applicant and the learned A.G.P.

The caste claim of the applicant is invalidated. 3.

Mr. Thorat, learned counsel for the applicant submits that the real brother of the applicant namely Prashant Namdev Govindwar is issued with the validity certificate of "Mannervarlu" Scheduled Tribe under the order of this Court dated 04.10.2017 in Writ Petition No.10376/2017. 4.

The learned A.G.P. seeks time to argue the writ petition on the ground that record is not received.

Considering the fact that real brother of the applicant is directed to be issued with the validity certificate under order of this Court as referred to supra, we allow the applicant to appear for interview on the post of Maharashtra Civil Engineering Services, Main Examination, 2019 as per result dated 28.07.2020 without insisting for the Scheduled Tribe certificate. The same is without prejudice to the contention of either parties. The applicant shall not be entitled to claim any equity.

Civil Application is disposed of.

Place the writ petition on 14.10.2020.
