The learned Assistant Government Pleader raises a preliminary objection that the petitioner has alternate, efficacious remedy by way of an appeal. Even the impugned order states that, the petitioner has remedy of appeal. 2.

In the light of that, though Mr. Wakade, the learned counsel sought to canvass the submissions on merits of the matter, we are not inclined to consider the same. The writ petition is disposed of with liberty to the petitioner to avail the

2 wp 5591.15 alternate remedy. All contentions are kept open. The authority where the appeal would be filed, shall consider the time spent in prosecuting present writ petition.
