Learned counsel Mr. S. R. Bodade holding for Mr. A. S. Usmanpurkar, learned advocate for the appellant/Insurance Company, learned counsel Mr. Joyeb Shaikh for the respondent No. 1/original claimant along with original claimant No. 1 for herself and on behalf of minor respondent Nos. 2 and 3/claimant Nos. 2 and 3 are present today. They tender on record terms of settlement, which are taken on record and marked as 'Exhibit - X' for identification.

With the assistance of learned counsel for the parties, we have ascertained the identification of the original

2 fa 1964.18.odt claimant/respondent No. 1. She confirms the terms of settlement and agrees for the final disposal of the first appeal as per the settlement.

The first appeal stands disposed of in terms of settlement Exhibit - X.

As per the settlement between the parties, the appellant/insurance company shall be paid an amount of Rs. 1,25,000/- (Rs. One Lakh Twenty Five thousands only), towards full and final settlement from the amount already deposited by the Insurance Company in this Court. Balance amount along with accrued interest shall be disbursed to the respondent Nos. 1 to 3/original claimants.

A request for refund of court fees shall be processed in accordance with law.
