DATE : OCTOBER 14, 2022 PER COURT :

1.

By this review application, the applicant namely Renuka Baburao Raut submits that none of her family members, on the basis of the Project Affected Persons (PAP) Certificate, has received any benefit, much less, any employment in any Government Office. On 18.04.2018, a group of petitions was disposed off in a short single paragraph order that as one person in the family has received the benefit, the petitions need not be entertained. 2.

The learned Advocate representing the University submits on the basis of the record that the University'

s record does not indicate that

- 2 - any member of the applicant'

s/petitioner'

s family has been granted any benefit under the PAP.

3.

He further points out paragraph No.10 of the affidavit in reply dated 30.07.2019 in response to the review application, as under :- "10. I say and submit that, the list of lands acquired by the deponentsUniversity is available with the deponents-University. In said list at Sr.No.142 and 143 names of Jija Munjaji, Babu Damodhar, Manik are appearing for land Sy.Nos. 50/3, 50/8 and 50/10. The appointment order is issued to Jija Munjaji as Majdoor under P.A.P. Category at Central Farm on 10.10.1984. The copy of said material document and order dated 10.10.1984 is hereto annexed and marked as Annexure-R1. That, there are 3 names appearing in the P.A.P. certificate. This itself is sufficient to prove that, the lands which are acquired by the deponents-University were jointly owned and possessed by the petitioner'

s family members."

4.

The learned Advocate for the petitioner/applicant submits that she does not belong to the Jija Munjaji or Babu Damodhar or Manik Family. She has an independent PAP certificate and no one from her family has been granted any employment or benefit. She, therefore, submits that the writ petition needs to be considered on it' s own merits.

- 3 - 5.

In view of the above, the review petition is partly allowed only to the extent of deleting Writ Petition 3180/2018 filed by the present petitioner, from the list of matters, which have been disposed off. Writ Petition No.3180/2018 shall stand restored at the stage at which it was disposed off.

6.
