It is submitted that the petitioner has filed Writ petition No.2985 of 2018, however this Court asked the petitioner to make appropriate application before the forum where the appeal is pending. The petitioner filed Interim Application bearing No.115 of 2018 before the Debts Recovery Tribunal, at Aurangabad for refund of the amount. For more than three years, the same is not decided. The stay is granted. The petitioner is auction purchaser. 2.

In the order dated 21-03-2018 passed in Writ Petition No.2985 of 2018 filed by the petitioner, this Court observed that if the petitioner tenders the application, the same be decided expeditiously. For more than three years, the same does not appear to have been Gajanan

The learned Debts Recovery Tribunal, at Aurangabad shall consider the application of the petitioner and pass the orders on it on its own merits, after hearing all the parties concerned, expeditiously. The said application be decided preferably within six months. 4.
