Application filed by the present applicant for anticipatory bail came to be rejected by Sessions Judge in connection with Crime No. 253/2024. The very same Sessions Judge in Cri. M.A. No. 242/2024 in respect of co-accused has made observations that the offence punishable under Section 436 of the Indian Penal Code is not prima facie attracted to the case in hand as there was fire in the poultry farm. He grants anticipatory bail to the said co-accused, however, rejects the application of present applicant. The said observations are more than sufficient to allow the present application. Hence, application stands allowed in terms of interim order dated 15.05.2024.
