This is second application filed by applicant seeking anticipatory bail in C.R. No. 65 of 2023 registered with Gategaon Police Station, Dist. Latur, for offences punishable under sections 364, 504, 506, 511 r/w 34 of IPC.

Anticipatory Bail Application No. 1419/2023 filed by applicant was rejected by this Court on 04.01.2024 observing that "allegations against applicant are serious and material on record, prima facie indicates applicant's involvement in the crime. Car used in the crime is yet to be seized. Applicant's custody is, therefore, necessary for effective investigation. This is not a fit case to exercise discretion in favour of applicant. Learned advocate for applicant submits that car of the applicant is now seized and 300 days have passed since the date of registration of crime. He therefore submits that applicant may be granted relief of anticipatory bail.

The submission is misplaced and misconceived. Merely because car is seized, this cannot said to be change in circumstance to grant discretionary relief of anticipatory bail to applicant. The observations made in the order dated 04.01.2024 are self explanatory. No case is made out by applicant for grant of relief. Application is, therefore, rejected. [NITIN B.
