By this Civil Application, the applicant (Varsha Thakur), Chief Executive Officer, Zilla Parishad, Nanded, has tendered an unconditional apology. She has prayed that the apology be accepted and the observations made by this Court in the order dated 05.05.2022 may be recalled.

We have considered the submissions of the learned advocates appearing for the respective parties. We have perused the entire contents of the Civil Application.

It is tried to be suggested that the Education Officer (Primary) may have played a mischief by attempting to compel the petitioner to teach mathematics subject when his appointment was for teaching English subject.

We were informed by the learned advocate for the Zilla Parishad that it was the present Chief Executive Officer who had directed the petitioner to teach mathematics subject though the said subject was foreign to him. Considering the overall conduct of the Chief Executive Officer that we had directed the Divisional Commissioner to issue a strict warning and enter the warning in her service record.

The learned advocate for the original petitioner submits that he has no grievance against the Chief Executive Officer. However, he is instructed to say that due to the unfair acts of the Education Officer and the Deputy Education Officer, people like the petitioner are harassed.

In view of the above and as the applicant has tendered an unconditional apology, we recall a portion of the last sentence in paragraph 13 of our order dated 05.05.2022 to the extent of "and to enter the said warning in her service record". These words would stand deleted from paragraph 13 of our order
