Heard learned counsel for respective parties. 2.

Present petition is directed against the order dated 25.02.2022 passed below Exhibit-149 by the learned Judge, Cooperative Court, Latur in Dispute No.366 of 2014, whereby the application for setting aside the no written statement order came to be rejected.

The petitioner, is the respondent no.10 in the dispute filed by present respondent no.1/bank. Though the counsel appeared in the matter in the year 2016, for one or the other reason, the written statement was not filed till the order of the Co-operative Court. Thereafter, the application was filed and no written statement order was passed thereon. The petitioner filed an application for setting aside the no written statement order and the same was

967-wp-6229-2022.odt (2) rejected by the learned Co-operative Court on the ground that the petitioner has not given sufficient cause to set aside the said order. 4.

As this matter was proceeded without written statement, therefore, with a view to give one more opportunity to the petitioner, I am inclined to allow the petition by setting aside the order 25.02.2022 passed below Exhibit-149 by the learned Judge, Cooperative Court, Latur in Dispute No.366 of 2014. 5.

In view of the above, the petition is allowed, subject to cost of Rs.10,000/- to be paid to Advocate's Association Bar Library, High Court, Aurangabad by the petitioner within a period of four weeks from today.
