Mr. Thoke, the learned counsel for the petitioner submits that, the petitioner has filed an appeal as per Rule 12(3) of the M. E. P. S. Rules before the respondent No. 2/Education Officer. The said appeal is filed in March 2014, however, no decision has been taken on it even as yet. Even representations are given to the respondent No. 2 from time to time but of no avail. 2.

The learned Additional Government Pleader submits that, in case appeal is pending, the respondent No. 2 would decide the same on its own merits.

In the light of the above, we pass the following order.

In case appeal filed by the petitioner under Rule 12(3) of the M. E. P. S. Rules is pending before the respondent No. 2, then the respondent No. 2 shall decide the said appeal on its own merits in accordance with law expeditiously and preferably within a period of six (6) months from today after hearing all concerned parties. The writ petition accordingly is disposed of. No costs.
