THE STATE OF MAHARASHTRA AND OTHERS ....

Mr Mukul S. Kulkarni, Advocate for petitioners; Mr S. G. Sangle, A.G.P. for respondents/State CORAM : RAVINDRA V. GHUGE AND ANIL L. PANSARE, JJ.

DATE : 14th June, 2022 PER COURT:

1.

We have perused the Judgment dated 23/12/2021, delivered by this Court in Writ Petition Nos.5396/2021 and 5403/2021 and the directions set out in paragraph No.30 that the State Government shall issue necessary Notification under Section 127(2) of the Maharashtra Regional and Town Planning Act, 1966.

296.22cp etc (2) 2.

Having considered the submissions of the learned Advocate for the petitioners and the learned A.G.P., we find that though a specific time period was not directed by this Court for issuance of the Notification, the State Government should have issued the same with promptitude. The reasonable period of issuing such Notification could have been three months in our view. Six months have lapsed.

3.

As such, we dispose off these contempt petitions with a direction that the State Government would issue a Notification under Section 127(2) of the Maharashtra Regional and Town Planning Act, 1966, on or before 30/07/2022. Violation of this direction would amount to an aggravated contempt. (ANIL L. PANSARE, J.) (RAVINDRA V. GHUGE, J.) sjk
