We find that the predecessor in title (respondent No.4 herein) has already preferred Special Civil Suit No.21/2021. The application for seeking injunction under Order 39 Rules 1 and 2 of the Code of Civil Procedure is also pending wherein, the plaintiff has put forth prayer clause 9-C that the compensation on account of land acquisition in Gat No.684 admeasuring 0.49 R should not be disbursed to anybody. The petitioners also pray before us that the said amount should not be disbursed.

Since the suit is pending, we do not deem it
