2] In view of the consent of the parties, Writ Petition stands allowed in terms of prayer clause B. The proceeding to the Suit is restored to the file of the Tahsildar. Parties agree to appear before him on 18/1/2016. The Tahsildar shall grant fresh opportunity of hearing to the parties and shall decide the issue afresh after taking into account the location of the properties of the parties and road passing through the same.
