The petitioner is complaining that the state had taken the possession of his land without acquiring it.

In affidavit in reply of this writ petition, which is filed by the Sub Divisional Officer, Partur, District Jalna in paragraph nos. 5 and 6, it is stated as under:

I, say and submit that as the possession of the lands of the petitioner was take and no compensation has been paid to the petitioner therefore now present deponent issued fresh notification U/s 11 (1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement, Act 2013 has been published by the Government
( 2 ) 15 wp 7173.16 Printing press Aurangabad on 18.2.2016 in the official Gazette. The copy of the same has been attached and marked Exh R-1. 6.
I, say and submit that as the procedure under the new Act Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement, Act 2013 by the deponent now it will take at least about 18 months time to complete the proceedings of acquisition and payment of compensation under the new Act to the petitioner. 3.
In view of this factual position as emerging from these two paragraphs, it is evident that the petitioners' grievances have been redressed. Nothing survives in this writ petition and the same is disposed of. [MANGESH S. PATIL, J.] [S.C. DHARMADHIKARI, J.] mub
