Heard learned counsel for the petitioner. He contends that payment of benefits of Assured Career Progress Scheme and time bound promotion have been paid belatedly and thus the loss suffered by petitioner on account of delayed payment deserves to be compensated by awarding interest. This has not been properly considered by the labour court and benefits have been declined observing that there is no pre-existing right, privilege and entitlement to award interest.

However, during further hearing, it transpires that

wp5222.19 petitioner has entered into a compromise with the employer before lok adalat. Mr. Barde fairly submits that in the said compromise, there is no reference or any assertion about interest nor any term over payment of interest. 3.

In view of aforesaid, having regard to that proceeding has been culminated into a compromise without any term in respect of payment of interest, it is not a case where it can be said that reasoned decision rendered by the labour court is liable to be interfered with. Writ petition is therefore, not entertained and is rejected.
