It would not be appropriate to preempt the proceedings before the learned Assistant Charity Commissioner Latur. The petitioner claims to have filed application U/Sec. 41-D of the Maharashtra Public Trust Act.

The A. C. C. Latur shall consider the said application and take decision upon it on its own merits and shall also consider all relevant aspects of the matter including tenability and locus.
