1 cp 404.2022
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 5 CONTEMPT PETITION NO.404 OF 2022 IN WP/14216/2021 SANGEETA DHONDIRAO INGOLE
VERSUS
THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY SHRI VIKAS RUSTOGI AND OTHERS ...
Advocate for Petitioner: Mr. Panpatte V. S.
AGP for Respondent No.1: Mr. S. B. Yawalkar Advocate for Respondent Nos.2 & 3:
Mr. S. B. Pulkundwar ...
CORAM:RAVINDRA V. GHUGE AND ARUN RAMNATH PEDNEKER, JJ.
DATE: 25th JULY, 2022 PER COURT:
1.
Considering our order dated 21.07.2022, we had called upon the Chief Executive Officer to place before us the concerned file and the outwards register. We have ourselves perused these two documents. The learned Advocate for the Petitioner has also perused the said document. There is nothing fishy about the order dated 25.02.2022 having been issued through the outward register.
2 cp 404.2022 2.
The learned Advocate for the Petitioner submits that he is not satisfied with the contents of the order 'X-1'.
3.
Needless to state, the Petitioner would be at liberty to assail the said order since that would amount to an independent cause of action and cannot be taken up as a part of the contempt proceedings.
4.
As such, the Contempt Petition stands disposed of with liberty to the Petitioner to challenge the order dated 25.02.2022 (X-1), as may be permissible in law.
