VERSUS

THE STATE OF MAHARASHTRA AND ANOTHER..RESPONDENTS ...

Mr. G. K. Chinchole h/f Mr. S. M. Vibhute, Advocate for the Petitioner.

Mr. S. G. Sangle, AGP for Respondents-State.

...

CORAM : RAVINDRA V. GHUGE AND ANIL L. PANSARE, JJ.

DATED : 23rd JUNE, 2022.

PER COURT:- 1.

Leave to add the Competent Tribe Scrutiny Committee as respondent no.3. Addition to be carried out forthwith. The learned A.G.P. causes an appearance on behalf of all the respondents. 2.

The petitioner does have a 'Mannervarlu', Tribe certificate recognized as Scheduled Tribe in the State of Maharashtra. The post for which he has moved an application for recruitment requires the tribe certificate of 'Mannervarlu' Tribe in the format as prescribed by the Central Government. 3.

The learned AGP submits that after the petitioner tenders the original certificate of 'Mannervarlu' Tribe, a fresh certificate in the format prescribed would be issued within 15 days.

(2) 909-wp-6151-2022 4.

The learned Advocate for the petitioner submits that his original tribe certificate of belonging to the 'Mannervarlu' Tribe is submitted to the Competent Validation Committee and it is a part of the said record. That certificate cannot be extracted out of the R & P. As such, we permit the petitioner to get an attested certificate of the 'Mannervarlu' Tribe from the Competent Authority itself and submit the same to the Competent Authority respondent no.2.

5.

The learned Advocate for the petitioner submits that he would complete the formalities of tendering the certificate on or before 15th July, 2022.

6.

As such, this petition is disposed off.

We expect the authority to issue the certificate as required in the format prescribed by the Central Government on or before 30th July, 2022, subject to final outcome in validation proceedings.
