Having considered the submissions of the learned advocates for the respective parties, it is apparent that the Education Officer (Secondary), Zilla Parishad, Latur has passed the impugned order oblivious of the law crystallized by this court vide judgment delivered in In Yogita Shivsing Nikam Vs State of Maharashtra and others, reported in 2022(2) MHLJ, 370 .

The learned AGP submits on instructions received in writing vide communication dated 1207-2022 from the Education Officer Mr. Nagesh Mapari that, he would issue an appropriate order within one week.

In view of the above, this petition is partly allowed. The impugned order dated 30-042020, is quashed and set aside. We direct the Education Officer, Mr. Nagesh Mapari to abide by the law laid down in the case of Yogita Nikam (supra) and issue an appropriate order in favour of the petitioner, on or before 30-07-2022.
