Respondent No.3 refused to accept the notice and it is also stated that he is not allowed the notice to be affixed, but then panchanama is not drawn. Those formalities need not be taken care of since it is suffice to say that when the Bailiff had gone, he refused to accept. It is a good tender. 4.

Taking into consideration the fact that the delay in filing the Second Appeal was of 25 days only, it stands condoned and the application stands disposed of. 5.
