Per Court :- Present Criminal Application is filed by the Applicant for grant of regular bail in connection with CR No.31/2015 registered with Police Station, Faizpur, District - Jalgaon, for the offences punishable under Section/s 420 read with 34 of the Indian Penal Code. [2] Heard Mr. Girish V. Wani, learned counsel for the Applicant and Mr. V.H. Dighe, learned Additional Public Prosecutor for the State of Maharashtra.

[3] Unemployed youth who was desperate to get the job, by name Prashant Pundlik Baviskar came into contact with the present Applicant, through one Birhade. The present Applicant pretended that he is I.B. Officer and he could provide employment to the First Informant in the Ordnance Factory of Varangaon as Store Keeper, however for that the first

2/2 cri.appln. 2859.15..sxw informant will have to pay Rs.50,000/- initially and Rs.2,50,000/- after job is secured. Due to lucid language used by the present Applicant, the man who was desperate to secure the job get allured in view of the promise given by the present Applicant and Rs.50,000/- were paid. However, after lapse of considerable period when the first informant could not get any job, he tried to establish the contact on telephone with the present Applicant. That time, present Applicant asked the first informant as to how much amount he has paid; upon that, first informant replied that he has paid Rs.50,000/- to the present Applicant. Upon that, telephone was cutoff and thereafter he avoided the contact with the first informant. That leads suspicion in the mind of the first informant and he approached to the police.

That time, it was noticed by the first informant that like him other unemployed youths were already cheated by the present Applicant by alluring them on the pretext of job. [4] Since the First Information Report was disclosing commission of cognizable offence, offence was registered. Applicant was arrested. During the investigation, at the behest of the present Applicant, recovery was made which includes certain documents which show that the Applicant has cheated about 30 to 35 persons.

[5] According to the learned Additional Public Prosecutor investigation is in progress. In that view of the matter, no case is made out to release the Applicant on bail. Hence, I pass the following order :-

ORDER

Criminal Application is dismissed.
