The petitioner is aggrieved by the order passed by the learned Adhoc District Judge-2, Nanded , belowExhibit-5 in Regular Civil Appeal No.35 of 2021, thereby granting stay to the judgment and decree passed in Regular Civil Suit No.173 of 2004 by the learned 2nd Joint Civil Judge, Junior Division, Nanded on 16/03/2021.

Having heard the learned advocate for the petitioner, learned advocate for respondent Nos.2 to 5, and the learned Assistant Government Pleader for respondent No.1, this Court is not inclined to interfere in the order passed by the Appellate Court considering the reasons given in the order.

Learned advocate for the petitioner submits that though the Appellate Court has expedited the matter, and the said order is passed on 22/03/2022, till date, the appeal is not taken up for hearing.

The Appellate Court to decide the appeal within a period of one year from the date of receipt of writ of this order. 5.

The writ petition is disposed of.
