The learned counsel for the applicants submits that there is delay of 45 days in filing the Second Appeal. 2.

The learned counsel submits that the family members of the applicant are suffering from medical issues, and that the applicants could not get a proper advise and that they were also not aware of the order passed by the first appellate Court. On receiving the information of the order passed, time was required to collect all the necessary documents and to engage an advocate to file second appeal.

The delay thus caused is not intentional.

For the reasons stated in the application, the delay of 45 days in filing the Second Appeal is condoned. The Civil Application is

disposed of accordingly.

Second Appeal be registered. Office objections, if any, to be removed.

List the matter on 01.09.2023.
