Heard the learned counsel for the applicant and the learned A.P.P. for the respondent.

The applicant seeks bail in C.R.No.48 of 2024 registered with Jawahar Police Station, Aurangabad, for the offence punishable under Section 370 of the Indian Penal Code and Sections 3, 4, 5 and 7 of the Immoral Traffic (Prevention) Act, 1956. 3.
The application has been opposed mainly on the ground that the applicant has been involved in the similar crime. 4.
As regards the evidence, the learned counsel for the applicant submits that the so-called victim has no complaint of any such forcible indulgence in sex work.

Considering the nature of the offence and the material available on record as well as health of the applicant, it would not be appropriate to keep her behind bar. However, apprehension of the prosecution of repeated involvement of the applicant in the similar crime may be guarded by imposing certain conditions. Hence, the order:-
ORDER
i) Bail application is allowed.
ii) Applicant Shobha w/o. Vasant Shukla be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) She should not involve in the similar offence. (b) She should not use the rented house for the purpose of running brothel.
(c) She should attend the trial on each and every effective date.
