It appears that while admitting the Second Appeal on 14.10.2016, it was stated by this Court that the matter be placed for final hearing on 23.02.2017. Now, by this application, applicant prays for early hearing on the ground that he is 73 years old and due to old age he is suffering from ill health. 2.

Though this Court had passed the said order, it appears that at any earlier point of time there was no attempt on the part of the applicant to get the appeal fixed for final hearing and now this attempt is made. Though he is senior citizen, there are other matters of senior citizens before this Court. Under such circumstance, no case is made out for fixing early date for final hearing.

Civil Application stands rejected.
