1) Heard.

Perused the pleadings of the petition, grounds raised therein and affidavit in reply filed on behalf of Respondent No.2.

2) It appears that the petitioner possesses a Graduation Certificate, which is at Exhibit R-2 (page 35 of the compilation of writ petition). We have carefully perused the contents of the said certificate, wherein it is specifically mentioned that, an ex-serviceman can may be considered eligible for appointment to any reserved vacancy in group `C' posts for which the essential qualification is graduation and where experience of technical or

professional nature is not essential. Therefore, it follows from the contents of the said Certificate that , on the basis of the said certificate the petitioner is eligible to be considered for appointment to any reserved vacancy in group `C' post. However, as rightly contended by the counsel for Respondent No.2, on the basis of the said Certificate, the petitioner is not eligible to be considered for a post falling in Group `B' post. In that view of the matter, we do not see any merit in the instant petition. Hence, the petition stands rejected.
