Heard the learned counsel appearing for the applicant and the learned A.P.P.
appearing for respondent/State.

Time being we are not inclined to entertain this application on merits.
However, keeping in view the ailment being suffered by the minor daughter of the applicant, we issue directions to the
Superintendent of Jail, Central Jail, Nashik Road, Nashik and the Divisional Commissioner, Nashik Division, Nashik to consider the proposed application to be filed by the applicant for releasing him on emergency parole invoking the rule 19 of the Prisons (Bombay Furlough and Parole) Rules, 1959.

The learned counsel appearing for the applicant submits that, the applicant or his wife would file an application within one week from today.

In the peculiar facts of this case, we also grant liberty to the wife of the applicant to apply for emergency parole to the concerned authority accompanied with the copies of the medical certificates, if any. If such application is filed within one week from today, the concerned authority to decide it within one week from filing such application.

Needless to observe that, during the course of hearing, the learned A.P.P. has brought to the notice of this Court that, the concerned Police have made enquiry and ascertained that the applicant's daughter is suffering from 7 x 6 x 5 cm
liver Hemangioma in Seg VI and advised for liver transplant.

With the above observations the application stands disposed of.
