IN THE HIGH COURT OF JUDICATURE AT BOMBAY,

BENCH AT AURANGABAD WRIT PETITION NO.6914 OF 2007 Dattatraya s/o Bajirao Kale ...

PETITIONER

VERSUS

The State of Maharashtra & others ...

RESPONDENTS .....

Shri R.S. Shejule, Advocate for petitioner Mrs. M.S. Patni, A.G.P. for State .....

CORAM:

S.V. GANGAPURWALA AND A.I.S. CHEEMA, JJ.

DATED:

25th March, 2015.

ORAL ORDER :

1.

The order dated 5.1.2000, thereby cancelling the licence of the petitioner as a stamp vendor is assailed in the present writ petition.

2.

We have heard learned counsel for the petitioner and learned A.G.P. for the State. It is submitted that, subsequent to the filing of the present petition, the petitioner has been acquitted of the criminal case filed against him on the basis of

W.P. No.6914/2007 which the impugned order is passed. The learned counsel submits that, the petitioner had filed Civil Application in the present Writ Petition. The said Civil Application is disposed of, wherein the petitioner was given liberty to approach the authority to file fresh application. The fresh application is also filed. However, the authority heard the matter and the said application is decided against the petitioner. The petitioner has challenged the said order by way of Writ Petition No.3696/2013 and the same is pending.

3.

As the Writ Petition No.3696/2013 filed by the petitioner against rejection of the subsequent application to grant licence is already pending, the present Writ Petition does not survive. The petitioner may prosecute the pending Writ Petition and agitate all the legal contentions on merits therein. In light of above, Writ Petition stands disposed of. Rule discharged. No costs.
