Heard the learned Counsel for the applicant and learned A.P.P. for the respondent.

It is alleged that on secret information the police arranged a trap and reached to the spot. After reaching the spot it was noticed that sand was being excavated by use of Poclain and was filled in Highwa. The police had the secret information with specific names of the persons who were committing theft of sand from the river bed. The applicant was also one of them. However, the applicant has come out with a case that on the date and time of the incident, he was not at the place of the incident, but he has been falsely implicated
ABA734.22 (2) in the crime by his rival group. He has filed the documents in support of his contention that at the relevant time he was on duty. So, prima facie he has a good case to be considered on merits. He deserves to be granted bail. Hence, the following order:- i) Application is allowed.
ii) In the event of arrest, the applicant Sachin s/o Narayan Salgar, shall be released on bail, in C.R. No.119 of 2022, registered with Sonpeth Police Station, Sonpeth, District Parbhani for offence punishable under Sections 379, 353, 109, 401, 430, 431, 432 read with Section 34 of the Indian Penal Code and Section 48 (7) (8) of the Maharashtra Land Revenue Code, on furnishing P.B. and S.B. of Rs.40,000/- with one or two solvent sureties of the like amount, on the condition that he shall attend the police station as and when called by the Investigating Officer.
