In view of the subsequent amendment to the Negotiable Instruments Act, in my opinion, the order dated 18th April, 2015, passed by Judicial Magistrate First Class, Jafrabad, Dist. Jalna, is not sustainable and as such same is set aside. S.T.C. No.119 of 2012 stands restored, which shall be decided by the learned Magistrate on merits.

Criminal Writ Petition stands allowed in above terms. 4.

Parties agree that they shall remain present before the learned Magistrate on 20th June, 2016.
