This civil application is preferred for condonation of delay of 1457 days caused in filing the first appeal.

The respondent No.2 is reported to be dead, no legal heirs are brought on record.

The learned AGP, however, points out on merits that the learned SLAO has awarded the total compensation at the rate of Rs.4,200/-. The said amount is enhanced by the trial Court i.e. learned Reference Court Ethape

( 2 ) 911-CA-8305-2013 and has granted the rate of Rs.1375/- per R.

Considering that the amount is meager, keeping the first appeal pending will be of no use. This Court thus finds that no notice is required. The appeal itself can be disposed off. 5.

In view of the said, delay stands condoned. Application is allowed. Office to register first appeal.

FIRST APPEAL 6.

For the reasons stated in the order passed in civil application, this Court finds that appeal deserves to be dismissed and the same is hereby dismissed. No order as to costs.
