The impugned order dated 30.05.2022 issued by the S.D.O. Gangakhed can be assailed u/s 247 of the M.L.R.Code. In so far as the release of the vehicle is concerned, we find it appropriate to direct the said authority, while considering his proceedings u/s 247, to deal with the request for release of vehicle and on conditions as may be deemed appropriate to be imposed on the petitioner including deposit of any portion of the penalty. The concerned authority would pass an order, expeditiously.

We make it clear that we have left it to the discretion of the said khs/July 2022/7054

- 2 - authority to consider the release of the vehicle and as regards the conditions that would be imposed.

As such, this petition is disposed off.
