Learned counsel Shri. Nagarkar for the applicant states that as per order dated 31/03/2021 in Civil Application No. 3645 of 2021 the petitioner-Kinetic Engineering Ltd. was directed to deposit Rs. 12 lakhs. The petitioner Kinetic Engineering company has deposited the said amount. Shri. Nagarkar, learned counsel submits that he is entitled to withdraw Rs. 3 lakhs out of the said amount. Learned counsel Shri. Bedre states that amount be paid on usual undertaking.

In view of this applicant Shrikrushna Manikrao Jadhav is permitted to withdraw an amount of Rs. 3 lakhs on giving an undertaking that he will deposit the entire amount in lump sum in case the decision of the petition goes against him. 3.

Civil Application is disposed of.
