th June, 2015 DATED : 25 PER COURT :- 1] This is an application for bail, since the applicant is arrested in connection with Crime No. 96 of 2015, registered with Karmad police station, District Aurangabad, for the offences punishable under Sections 307, 498-A of the Indian Penal Code.

2] The first informant is wife of the present applicant. She is his second wife. According to the first information report itself there is a matrimonial discord in between the couple. According to the first information report, on 11.5.2015 when the first informant had been to a temple, that time the applicant put a wire around her neck and tried to kill the first informant. No doubt there is a statement of one Arun who is supporting the first informant. However, the entire investigation appears to be over and only formality of filing of

charge sheet is remained to be done. The wire is also seized and recovered. The injury around the neck is just abrasion.

3] In view of the fact that the investigation is almost complete and only formality of filing of charge sheet is remained to be done and the applicant is in jail since 11.5.2015, there is no possibility that the offence being converted into more graver one. Hence, the applicant can be released on stringent conditions. That leads me to pass following order.

O R D E R

(i) Criminal Application is allowed.

(ii) Applicant-Baban s/o Tejrao Mhaske be released on bail, in connection with Crime No. 96 of 2015, registered with Karmad police station, District Aurangabad, for the offences punishable under Sections 307, 498-A of the Indian Penal Code, on he executing P.R. bond of Rs.25,000/- with two solvent sureties in the like amount. (iii) Bail before the trial court.

(iv) Applicant-Baban shall not enter the territorial jurisdiction of village Chartha, District Aurangabad and he shall not pressurize or cause any harm to the first informant.

(v) The applicant shall attend Karmad police station once a week, preferably on every Sunday in between 3.00 p.m. to 5.00 p.m. till charge is framed; and subsequently he shall attend the said

police station once a fortnight on every Sunday in between 3.00 p.m. to 5.00 p.m. till charge is framed.

(vi) Application is disposed of.
