It appears that the appeal fled by the original
{2} 914-crappeal84.23.odt complainant, arising out of same judgment and order, is already registered as Criminal Appeal No. 84 of 2023. Even if the leave is not granted, as prayed by the learned A. P. P., then also the appeal of the complainant will have to be heard on merits. Moreover, if the leave is granted, both the appeals are required to be heard together.
Considering this aspect, the Criminal Application fled by the State for leave to fle appeal is hereby allowed. The State appeal be registered after removing all the offce objections, if any. It is made clear that the leave is not granted considering the merit of the case.
Place both these appeals for admission after registration.
